Sparklight strives to provide customers the best experience when using our network. As a shared resource among hundreds of thousands of customers, Sparklight uses proactive management to ensure customers are not negatively impacted by the few users who may be causing network slowdown.
Certain actions may be taken to prevent this situation:
- If you use an extraordinary amount of data based on your data plan or service level and fall within the top 5% of Sparklight's data users, we may reduce your data throughput speeds periodically for the remainder of your current billing cycle and next billing cycle. This is to ensure high-quality network performance for other users during times of peak demand and is designed to ensure that the remaining 95% of data customers are not negatively affected by the inordinate data consumption of just a few users.
- Sparklight may also use other tools and techniques to manage its network, deliver the service, and ensure compliance with this Policy and the Subscriber Agreement. These tools and techniques are dynamic, like the network and its usage, and change frequently. For example, these network management activities may include the following:

- identifying spam and preventing its delivery to customer email accounts
- detecting malicious Internet traffic and preventing the distribution of viruses or other harmful code or content
- limiting speeds during periods of extended congestion
- requiring an upgrade or purchase of a different data plan
- using other tools or techniques that Sparklight may be required to implement to meet its goal of delivering the best broadband Internet experience to all its customers.
