Sparklight strives to provide customers the best experience when using our network, a shared resource among hundreds of thousands of customers. To help achieve this, if you use an extraordinary amount of data, based on your data plan or service level, and fall within the top 5% of Sparklight's data users we may reduce your data throughput speeds periodically for the remainder of your then current billing cycle and next billing cycle to ensure high quality network performance for other users during times of peak demand. Our proactive management of the Sparklight network and the Service is designed to ensure that the remaining 95% of data customers aren't negatively affected by the inordinate data consumption of just a few users. Sparklight also may also use other tools and techniques to manage its network, deliver the Service, and ensure compliance with this Policy and the Subscriber Agreement. These tools and techniques are dynamic, like the network and its usage, and can and do change frequently. For example, these network management activities may include (i) identifying spam and preventing its delivery to customer email accounts, (ii) detecting malicious Internet traffic and preventing the distribution of viruses or other harmful code or content, (iii) limiting speeds during periods of extended congestion, (iv) requiring an upgrade or purchase of a different data plan, and (v) using other tools or techniques that Sparklight may be required to implement in order to meet its goal of delivering the best broadband Internet experience to all its customers.
